If you do not have written proof that you retain the rights to the photos you have taken
and they are used for a flier, community announcement, interview, a magazine cover
or feature, YOU can be held liable by the photographer. The photographer is being
paid to shoot you for your portfolio. If he/she releases rights to you then you can use
as you wish.
Some photographers will only release for promotional use, but not for commercial
(e-commerce, campaigns). This is why we ALWAYS recommend you have the
photographer sign a release before the shoot date. In addition, if you want to use
those photos for anything in the future, you will need the high resolution images for
TV, PRINT, etc.
Will you be able to use any other photos from your shoot in the future
and have someone else do the “photoshop”?
Photographers are very protective of their work and most will not allow you to do
this. This should be stated in your release.
Will he/she be shooting anyone else during your shoot?
As a model, you assume that you will be shooting in a studio or on location with the
crew you hired. However, there have been times when a photographer will shoot two
models in one day. The photographer should tell you that ahead of time. Don’t wait
for them to tell you; ask first.
Will your shoot be a closed set?
This is good to know, especially if you are doing swimwear and/or lingerie and would
prefer that only the crew you hired be on set.
