Estate Planning and Probate Section

T
he Estate Planning and Probate Section had a great
turnout at our first breakfast meeting. In June, Attorney Margaret W. Scott advised us of international
estate planning issues we should consider when planning
for clients who have foreign connections. Her topic was
“International Estate Planning Basics – What Every Estate
Planner Should Know.”
In lieu of a meeting, in July most Section members attended
the Annual Fiduciary Law Institute in St. Simons Island,
Georgia. Along with our sponsors and other members of the
Bar, we enjoyed our traditional Wednesday opening reception
at the King & Prince Resort. Thanks to well-organized work
of our Section Treasurer, Albert Caproni, III, the reception was
a great success. The attendees, room setup, food, drinks,
service, and view of the ocean made the event very nice and
pleasant. I believe everyone had a good time.
On August 12, 2015, Jeff Pennell spoke to the Section about
“Current Developments of Importance to Estate Planners.”
Jeff gave us a copy of his most recent writing on this topic
and reminded us to coordinate the terms in our clients’ various
estate planning documents. (See Jimenez v. Corr, 766 S.E.
2d 115 (Va. 2014)).
September- Special Event
In September, in addition to our regular breakfast meeting,
our Section will have a joint CLE event with members of
the Elder Law Section and Financial Planning Association
(FPA). The event will be on Thursday, September 24, 2015,
from 6:00pm until 8:15pm at the law office of Dentons located
at 303 Peachtree Street, Suite 5300, Atlanta, Georgia, 30308.
Many thanks to our newest board member, Elaine Levine, who
spearheaded this event. Others who assisted in organizing
this event include Section Board members, members of the
Elder Law Section and the FPA, the Atlanta Bar Association,
and the law office of Dentons.
The topic is “The Truly Modern Family – What Would You
Do?” I believe this event is the first of its kind where attendees
will have the opportunity (1) to observe how professionals
from various disciplines work together to analyze and design

an estate plan and (2) to consider how the client may be
better served when professionals from the various disciplines
(estate planners, elder law attorneys, and financial planners)
work together.
The moderator is Attorney Doug Duncan, who has an
extensive background in estate planning, insurance, taxes,
and business planning. Attendees will have the opportunity to
hear what the panelists would do if they represented or were
working with the proposed hypothetical modern American
family. Panel members include Judge Rosh; estate planning
attorney Russell P. Love; and CPA, Attorney, CFP, AIF,
CRPS, and Financial Advisor Marta Shen.
