The Court will refrain from deciding constitutional questions when it can
decide a dispute on other grounds. There is no specific authority to impose warrantless
searches. N.D.R.Crim.P. 46(a)(2)(M) does contain a potential “catch-all” however, such
conditions must be supported by explicit findings of their appropriateness. The good faith
exception is not available in 4 circumstances. One such circumstance is when a warrant
was based on an affidavit "so lacking in indicia of probable cause as to render official
belief in its existence entirely unreasonable.”
